Theresa A. Capistrant

Theresa (Traci) A. Capistrant focuses her practice on Family Law. Raised in North Saint Paul, Minnesota, Traci graduated from the University of Minnesota, with a B.S. in Business Administration in 1985. She attended William Mitchell College of Law and graduated, cum laude, in 1988.

Traci began her legal career as an attorney with the Oppenheimer, Wolff and Donnelly Law Firm.  During her two-plus years with that firm, her areas of practice included insurance coverage, employment law, and products liability, all from the corporate perspective.  Transitioning her focus to Family Law, Traci joined the law firm Peterson, Fishman and Livgard, P.A in 1991.  Two years later, she became a partner.  In the following years, Family Law became the bulk of Traci’s work.

In January, 2001 Traci launched Capistrant and Associates.  The firm expanded with the addition of attorney Rebecca Wong in June 2002.  In 2009, Rebecca became a partner and the Capistrant and Associates was renamed Capistrant and Wong.

During her legal career, Traci has handled everything from simple, straightforward divorces, to complex custody and financial litigation in cases involving custody, paternity, dissolution, post decree enforcement, child support enforcement/modification, parenting time and custody disputes and a myriad of other issues that arise in a family situation. Traci has resolved cases through both settlement and the formal trial process.

More recently, Traci became trained as a mediator and as a Social Early Neutral Evaluator (SENE).   This allows her to assist clients in resolving their disputes in a less adversarial way. Traci has mediated complex custody and parenting time cases independently and through the Ramsey County Volunteer Mediation program.  The SENE process can help families to avoid the need, expense and emotional drain of a full custody or parenting time evaluation. Traci has been listed as a member of the Anoka, Ramsey, and Washington County SENE rosters, so she can provide this service through either of those counties or independently.
